Muslim Brotherhood front group Council on American Islamic Relations – Minnesota (CAIR-MN) should lose tax-exempt status

  • Information about the connection between CAIR-MN and the terrorist network HAMAS.
  • What did CAIR-MN do to violate IRS code.
  • How to send a complaint to the IRS about CAIR-MN violating code.
CAIR is HAMAS

November 16, 2018, Duluth News Tribune, “Flanagan, Walz pick labor, faith and business leaders for transition advisers,” announced Jaylani Hussein, executive director of the Council on American Islamic Relations-Minnesota (CAIR-MN), as a member on the incoming Minnesota Governors transition advisory board.

This is not good news for Minnesota. Why? Because CAIR is a front group for terrorist organization the Muslim Brotherhood.

CAIR was also designated as an unindicted co-conspirator during the 2008 Holy Land Foundation trial. FBI Special Agent Lara Burns testified that CAIR was a front group for radical organizations operating in the U.S. funding terrorist organization activity—specifically Hamas.

The Center for Security Policy describes the association between CAIR and terrorist organization Hamas in a 2016 publication “C.A.I.R. is HAMAS: How the Federal Government Proved that the Council on American Islamic Relations is a Front for Terrorism.”

“In 2008, the United States Department of Justice successfully prosecuted the Holy Land Foundation for Relief and Development (HLF) and its founders on 108 charges, including material support for terrorism, money laundering and tax fraud. The government’s theory of the case, successfully proven at trial, was that the Holy Land Foundation was established as a front group of the Palestine Committee—a covert organization of the U.S. branch of the Muslim Brotherhood—and that its purpose in this conspiracy was to provide funds for the Palestinian terrorist organization, Hamas.”

Further,

“…CAIR cloaks itself in claims of moderation while promoting the same Islamic supremacist agenda of encouraging American Muslims to support Jihad, both against Israel and elsewhere. While the group publicly promotes a toned-down version of Islamist rhetoric for the American public as a whole, its own history belies these claims of moderation.

A number of CAIR’s employees and board members have been indicted, convicted and deported for terrorism or material support for terrorism, as noted by the Louisiana State House of Representatives when it voted to support a prohibition against state officials “interacting with the group.”

October 8, 1997, Hamas was designated a terrorist organization by the U.S. Secretary of State in accordance with section 219 of the Immigration and Nationality Act (INA).

CAIR is Hamas, an offshoot of the Egyptian Muslim Brotherhood.

One has to ask… Why, in spite of the unequivocal evidence and testimony, does CAIR continue to enjoy tax-exempt status as a nonprofit under the guise of being a human rights organization in the U.S.?

And, was the inclusion of the executive director of CAIR-MN on the governor elects advisory board a little “I’ll scratch your back if you scratch mine?”

Last October, CAIR-MN executive director Jaylani Hussein held a press conference announcing the publication of a report titled, “Minnesota’s Anti-Muslim Propaganda Mill.”

Read the report here: https://isaiahmn.org/wp-content/uploads/2018/10/The-Propaganda-Mill.pdf

By publishing this report CAIR-MN, ISAIAH, UniteCloud, in association with other nonprofits, violated their 501(c)(3) tax-exempt status by actively campaigning in opposition to candidate(s) running for state and federal public office in the 2018 general and primary elections in the state of Minnesota.

The report not only included a candidate running in a congressional race, but also included the MN GOP republican gubernatorial candidate Jeff Johnson.

What can we do when the Minnesota Governor elect and sitting members of Congress like Tom Emmer legitimize organizations, such as CAIR, by meeting with them and appointing them to advisory boards?

Well, for one thing, any citizen may submit IRS Form 13909 requesting the IRS evaluate violations of tax-exempt status by nonprofit organizations, such as CAIR, in light of the organizations blatant violation by directly interfering in political campaigns.

Concerned about retaliation or reprisal? IRS Form 13909 may be submitted anonymously.

COMPLAINT

Violation: IRS Rev. Rul. 2007-41 (See Situation #16)

This is a complaint against CAIR-MN, ISAIAH, UniteCloud and all other nonprofits whose logo are included in an October 2018 report “Minnesota’s Anti-Muslim Propaganda Mill,” for violating their 501(c)(3) nonprofit charters and tax-exempt status. These groups actively campaigned in opposition to candidate(s) running for state and federal public office in the 2018 general and primary elections in the state of Minnesota.

Written documents and verbal comments made by directors of these groups are explicitly in violation of Revised IRS Rule 2007-41 (as illustrated in Situation #16). Specifically, the IRS code states:

“Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office. Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity. Violating this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise taxes…. voter education or registration activities with evidence of bias that (a) would favor one candidate over another; (b) oppose a candidate in some manner; or (c) have the effect of favoring a candidate or group of candidates, will constitute prohibited participation or intervention.”

With this complaint I am requesting the IRS enforce this rule which clearly and patently prohibits nonprofit 501(c)(3) tax-exempt organizations from directly or indirectly participating in, or intervening in, political campaigns on behalf of (or in opposition to) any candidates for elective public office. The law is clear and should be enforced to its fullest extent including revocation of tax-exempt status of these organizations and possible imposition of certain excise taxes.

CAIR-MN, ISAIAH, UniteCloud, and all other associated nonprofits have openly shown bias favoring one candidate over another; opposing candidate(s) in a written document and public statements of position; and have effectively favored candidates over others, constituting participation and/or intervention in 2018 political campaigns. These groups have flagrantly violated the prohibition against participation or intervention in political campaign activity.

RECORDS OF EVIDENCE

On October 18, 2018, just days prior to the November elections, CAIR-MN, ISAIAH, and UniteCloud, all 501(c)(3) nonprofit corporations, announced the publication of a report “Minnesota’s Anti-Muslim Propaganda Mill.”

Verbal and written public statements of position on behalf of the organization(s) in opposition of gubernatorial candidate Jeff Johnson and U.S. house of representative’s candidate A.J. Kern, clearly violate the prohibition against political campaign activity Revised IRS Rule 2007-41.

An October 2018, press conference held by CAIR-MN, ISAIAH, and UniteCloud was reported by the Minneapolis Star Tribune in the article ‘Report by Minnesota groups condemns anti-Muslim rhetoric’.

The Star Tribune article wrote,

“Hussein specifically criticized Johnson [governor candidate], who has said on the campaign trail that it’s ‘time to pause refugee resettlement.’ Hussein said using refugee resettlement as a political point is ‘a code word for anti-Muslim rhetoric.”

The cover page of the report includes unflattering photographs of the two political candidates along with other individuals accused of being anti-Muslim. Within the report, negative statements about these candidates, effectively discourages voters from supporting Jeff Johnson and A.J. Kern.

Statements on page 27 of the report condemned candidate Jeff Johnson:

“…the Republican Gubernatorial candidate; and everyone else who sits on the boards… merit public condemnation from across the political spectrum.” (See attached “Minnesota’s Anti-Muslim Propaganda Mill”)

Further, in an ISAIAH facebook post on October 18, 2018, Mr. Hussein again violated the CAIR-MN 501(c)(3) prohibition on campaigning by instructing people to vote against these candidates. (Situation #16 in IRS guidance)

“It’s a beautiful thing for groups to condemn anti-Muslim rhetoric in the state. It’s even better when we all shine the light together and say you won’t get our #MNVotes by scapegoating our neighbors. Minnesotans are #GreaterThanFear. #MNGov CAIR-Minnesota (CAIR-MN)

UniteCloud Natalie Ringsmuth (far left) and CAIR-MN Jaylani Hussein (speaker)

A video of the press conference can be found on ISAIAH’s facebook page:

Mr. Hussein states in the press conference video,

“In fact, right now one of the politicians who’s running for governor has repeated statements about refugee resettlement which is what we believe is a code word for Somalis… that is a code word for anti-Muslim rhetoric….”

CAIR-MN and ISAIAH clearly and distinctly violated the IRS political campaign intervention restriction. CAIR-MN executive director Jaylani Hussein made bias statements during an official press conference, shortly before the November elections, in which Mr. Hussein in opposition to Jeff Johnson’s gubernatorial campaign, publicly asserted Jeff Johnson’s position on refugee resettlement “is anti-Somali… a code word for anti-Muslim rhetoric.” A prominent issue in the 2018 campaign that distinguished the candidates.

Accusations of a ‘dog-whistle’ by gubernatorial candidate Jeff Johnson is in fact a dog-whistle itself by CAIR-MN executive director Jaylani Hussein. This is a clear statement, guiding voters to vote against Jeff Johnson in direct parallel to Situation #16 identified in the IRS revised rule.

IRS Rev. Rul. 2007-41 (Situation #16)

Situation 16. Candidate A and Candidate B are candidates for the state senate in District W of State X. The issue of State X funding for a new mass transit project in District W is a prominent issue in the campaign. Both candidates have spoken out on the issue. Candidate A supports funding the new mass transit project. Candidate B opposes the project and supports State X funding for highway improvements instead. P is the executive director of C, a section 501(c)(3) organization that promotes community development in District W. At C’s annual fundraising dinner in District W, which takes place in the month before the election in State X, P gives a lengthy speech about community development issues including the transportation issues. P does not mention the name of any candidate or any political party. However, at the conclusion of the speech, P makes the following statement, “For those of you who care about quality of life in District W and the growing traffic congestion, there is a very important choice coming up next month. We need new mass transit. More highway funding will not make a difference. You have the power to relieve the congestion and improve your quality of life in District W. Use that power when you go to the polls and cast your vote in the election for your state senator.” C has violated the political campaign intervention as a result of P’s remarks at C’s official function shortly before the election, in which P referred to the upcoming election after stating a position on an issue that is a prominent issue in a campaign that distinguishes the candidates.

Gubernatorial candidates Jeff Johnson and the Democrat nominee have stated their positions on the federal refugee resettlement program. Johnson has essentially indicated that he would favor a temporary moratorium on the refugee resettlement program until the state gains further insight on transparency and accountability or perhaps end the state’s official participation in the federal program. The democrat candidate does not favor a disruption in the program.

Jaylani Hussein, executive director of CAIR-MN, a section 501(c)(3) organization promotes a continuation and growth in the refugee resettlement program in the state of Minnesota.

Mr. Hussein continued his intervention campaign by hosting an event held at St Cloud State University (SCSU) on Friday, November 2, The Parallels of the 1920’s KKK to the Islamophobia Industry.

During the SCSU event Mr. Hussein used the report “Minnesota’s Anti-Muslim Propaganda Mill” cover to highlight the faces of both candidates Jeff Johnson and A.J. Kern including statements of bias concerning both political candidates.

One attendee to the event stated,

“CAIR-MN executive director Jaylani Hussein presented his organizations report, ‘Minnesota’s Anti-Muslim Propaganda Mill,’ showing both AJ Kern’s and gubernatorial candidate Jeff Johnson’s face.

The message from Mr. Hussein was to claim that these candidates were presumably “anti-Muslim” even though he presented absolutely no evidence of this. The photos used were unmistakable to myself and my friends in the audience. I was shocked that he’d use this while Natalie Ringsmuth, Director ofUniteCloud, sat in the row behind me. She also was with him as he had made the press announcement of this “report” along with some ISAIAH MN members. And all this with the election just days away.

I have heard Mr. Hussein at other presentations (Stillwater, Mn and Historical Society of Minnesota onOctober 6, 2018) where he makes political and unsubstantiated accusations against Minnesotan who seek legitimate answers of their elected officials usually sponsored and connected with UniteCloud and ISAIAH MN.”

CONCLUSION

With this complaint I am requesting the IRS agency to fully enforce IRS Rev. Rul. 2007-41 prohibiting nonprofit tax-exempt organizations from campaigning. The law is clear and should be enforced to its fullest extent including revocation of the nonprofit tax-exempt status of these organizations, CAIR-MN, ISAIAH, UniteCloud, and other 501(c)(3) organizations logo included in the October 2018 report “Minnesota’s Anti-Muslim Propaganda Mill,”
